Terms of Service

1. Agreement to terms
By creating an account or using Everfetch (“Everfetch,” “we,” “our”), you agree to these Terms. If you don't agree, don't use the service.
2. Accounts and workspaces
You may sign up with a verified email address. Each workspace has one or more members; the workspace owner is responsible for paying any subscription on that workspace. You're responsible for the activity of all members and API keys you authorize.
3. Subscriptions and billing
Paid plans (Starter, Pro, Enterprise) renew automatically each billing period at the price disclosed at signup. By upgrading you authorize Everfetch (via Stripe) to charge your payment method on each renewal until you cancel.
Upgrades take effect immediately and incur a prorated charge for the remainder of the current period. Downgrades take effect at the end of your current billing period. All sales are final. We do not issue refunds for unused time, partial periods, cancellations, or downgrades. See our refund policy for details.
4. Acceptable use
Don't use Everfetch to fetch personal data of others without lawful basis, bypass authentication, evade rate limits we set, redistribute the API directly to third parties, or target sites whose terms expressly prohibit automated fetching where you don't have permission. We may suspend workspaces that violate these rules.
5. Customer content
You retain ownership of the inputs, URLs, parameters, prompts, outputs, and other content you submit to or receive from Everfetch. We do not claim ownership of that content.
We process customer content only to provide, secure, debug, support, and bill the service, or as otherwise described in our privacy policy. We do not train models on customer inputs or outputs.
6. Outputs and reliance
Everfetch fetch results, extracted metadata, generated fields, and other outputs may be incomplete, stale, unavailable, or inaccurate. You are responsible for reviewing and verifying outputs before relying on them, publishing them, or using them for business, legal, financial, medical, or other consequential decisions.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. Free and self-serve plans are provided as-is. Enterprise customers may negotiate a specific SLA in writing.
8. Data and privacy
We handle account data and request logs per our privacy policy. Local CLI fetches run from your machine. Hosted API fetches are processed by Everfetch-managed infrastructure and selected service providers. We do not sell your personal data. Payment information is held by Stripe and never touches our servers.
9. Termination
You may cancel at any time from your billing page. We may terminate or suspend access for violations of these Terms; we'll generally give notice unless the violation is severe or fraudulent.
10. Limitations and liability
The service is provided as-is. To the maximum extent permitted by law, Story Ginie's total liability arising from these Terms is capped at the fees you paid in the prior 12 months.
11. Changes
We may update these Terms; we'll post the new version here with a new “last updated” date. Material changes to pricing or billing will be communicated by email at least 14 days in advance.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction and venue for disputes arising from or relating to these Terms or the service, and each party consents to those courts.
Before filing a claim, each party will make a good-faith effort to resolve the dispute informally by sending written notice and allowing 30 days for response. To the extent permitted by law, claims must be brought only on an individual basis, not as a plaintiff or class member in a class, collective, consolidated, or representative action.
